Abstract
A sophisticated contract between Friedrich Schiller and the Tübingen (Württemberg) based publisher Johann Friedrich Cotta that looks like a copyright contract, but is in effect a bilateral agreement. There was no statutory copyright protection in any German lands before the Prussian Statute Book of 1794 (see d_1794), and the state of Württemberg in particular was notorious for its reprinting industry. The contract concerns the publishing arrangements for the subscription journal Horen. Edited by Schiller from 1795-1797, Horen is now recognised as one of the most important periodicals of the German enlightenment. Apart from Schiller, contributors included Goethe, Fichte, Herder, Wilhelm von Humboldt and Karl Ludwig Woltmann.
The commentary discusses the conceptual relationship between copyright and contracts, focussing on the copyright-like features of the Horen contract which include advances, royalties, options, and even what would now be termed a moral rights clause. Clause (5) reserves the right of the author to make modifications. Clause (8) provides that an essay submitted to the journal may not be re-printed elsewhere until the end of four years after the publication in Horen. Clause (9) secures an option to the publisher on all future writings of the editorial board, provided that they are not already contracted elsewhere. Clause (15) promises a royalty to the editors of one third of profits on sales beyond 2000 copies.
The commentary also reviews Schiller"s professional life as one of the first German free-lance authors (in particular with respect to the importance of the subscription business model in a non-copyright environment). Some aesthetic innovations of Horen are discussed, such as the role of the editorial board and peer review.
