accused shall be found guilty of the crime of piracy, and that consequently will be ordered that all unsold pirated copies available will be seized, furthermore, this here accused will be ordered to pay compensation of damages amounting to NLG 2700, being the amount of the purchase price for 300 copies, calculated at NLG 9, for which the original French copy and Low German translation is published, both seizure and compensation, for the benefit of the complainant, as well as the cost of the Proceedings; all without prejudice to such a demand as the Lord Public Prosecutor may understand necessary to make in the interest of the State.
Having heard the statement of defence delivered by the defendant, to this effect that the Claim be denied, and the prosecutor and the Civil Party be ordered to pay the costs.
Having heard the subsequently delivered advisory opinion by the Public Prosecution Department, declaring that, according to Art. 7, 9, and 11 of the Decree of 24 January 1814, the Decree of 24 January 1815, and the Act of 25 January 1817, and furthermore under Art. 194 of the Code of Criminal Instruction, the hereby made Claim and statement by the plaintiff and civil party will be adjudicated to them; that Johannes Christoffel van Kesteren will be declared Guilty of the Crime of Piracy, and consequently will be fined as much as, as resulting from aforementioned Articles, this Court may deem appropriate; and ordered to pay the costs of the proceedings.
In view of the Instruction of the aforementioned pleadings.
All the formalities set out by law, so far as still in force, having been observed.
Given Art. 7, 9, and 11 of the Decree of 24 January 1814, and Art. 4 of the Decree of 25 January 1817.
Which Articles have been read by the President.
Considering that it is demonstrated in the Judicial Proceedings that the claimant and Civil Party, Samuel Delachaux, bookseller residing in this City, on 22nd April 1820, to the Lord Mayor of this City, has presented for translation the Copy of a certain work, originally


    


beklaagde zal worden verklaard schuldig aan het wanbedrijf van nadruk, en dat dienvolgens zal worden gelast, dat alle de nog ongedebiteerde voor handen zijnde exemplaren van den nadruk zullen zijn geconfisqueerd, mitsgaders hij beklaagde zal worden veroordeeld tot eene schadevergoeding van f 2700, zijnde het bedrag van den koopprijs voor 300 exemplaren, gerekend tegen f 9, waar voor in het oorspronkelijk fransch exemplaar en dat der nederduitsche vertaling wordt uitgegeven, beide zoo wel Confiscatie als schadevergoeding, ten behoeve van den klager, als mede in de kosten van den processe; alles onverminderd zoodanig requisitoir als den Heer Officier van Justitie in het belang des Staats mogt begrijpen te moeten nemen.
Gehoord de conclusie aan zijde van den gedaagden gedaan en genomen, tenderende tot ontzegging van den Eisch, en Comdemnatie van den Eyscher en Civiele Partij in de kosten.
Gehoord de daarop genomene Conclusie, door het Openbaar Ministerie, houdende, dat, naar Aanleiding van Art. 7, 9 en 11 van het Besluit van 24 Januarij 1814, het Besluit van 24 Januarij 1815, en de Wet van 25 Januarij 1817, mitsgaders krachtens art. 194 van het Wetboek van Criminele Instructie, de door den Eyscher en civiele partij, ten dezen genomene Eysch en conclusie aan denzelven zal worden geadjudicieerd; dat Johannes Christoffel van Kesteren zal worden verklaard Schuldig aan het Wanbedrijf van Nadruk, en dien ten gevolge zal worden veroordeeld tot eene geldboete van zoo veel, als naar aanleiding van bovengemelde Artikelen, deze Regtbank zal vermenen te behooren; Met Condemnatie in de kosten van den Processe.
Gelet op de Instructie van bovengemelde Conclusien.
Alle de formaliteiten bij de wet voorgeschreven, voor zoo verre die als nog in observantie zijn, in acht genomen zijnde.
Gezien Art. 7, 9 en 11 van het Besluit van 24 Januarij 1814 en Art. 4 van het Besluit van 25 Januarij 1817.
Welke Artikelen door den President zijn voorgelezen.
Overwegende, dat het ten Processe Consteert, dat de klager en Civiele Partij, Samuel Delachaux, boekverkoper binnen deze Stad woonachtig, op den 22 April 1820, aan Heeren Burgemeesteren dezer Stad, ter vertaling heeft vertoond het Exemplaar van zeker werk, oorspronkelijk
