      but so that the widow can hold this while she is alive,
      the husband must have assigned this right to her in their
      marriage contract. If this stipulation is missing,
      presumably what is stated in art. 2 of the decree from
      the Convention would be applied. The meaning
      of the word children has raised some doubts;
      but on 4 May 1822 the Court of the First Instance of the
      Seine ruled in the lawsuit between Mr. Agasse’s widow
      and Mr. Verdière regarding the Curso de literatura by Laharpe,
      that should be taken in the strict sense and which excluded
      the collateral inheritors, whose rights were prearranged
      by the law of 1793, and not abolished by that of 1810.
      
      It is about time to finish the heavy task I have started.
      What I have said should be enough for the editors of the Madrid
      Gazette, to figure out that article that
      they published; it is mistaken on its main object; almost all
      the legal points that it incidentally mentions are bewildering;
      it is an unpalatable allegation that gets involved in at every step
      with already insinuated matters, some of which are inconveniently
       mixed together. There are contradictions between them, and
      to sum this up, everywhere you can see he (Escriche) is far from being a
      model in language, style and knowledge, as they believed he was.
      Their disappointment is less important than that of the public,
      who, when seeing certain doctrines in the Diccionario
       de legislacion, could take them for granted,
      without examining them, and therefore they should be warned
      of their contradiction with the good principles of law.

      pero para que lo conserve la viuda mientras viva, es preciso que
      el marido le haya asignado este derecho en el contrato matrimonial.
      Faltando dicha condicion, presumo se observará lo dispuesto por
      el art. 2 del decreto de la Convencion. Se han suscitado dudas so-
      bre la inteligencia de la palabra hijos; pero el tribunal de primera
      instancia del departamento del Sena falló en 4 de mayo de 1822,
      en el pleito entre la viuda Agasse y el Sr. Verdière acerca del Cur-
      so de literatura de Laharpe, que debía tomarse en sentido estricto,
      y que escluia á los herederos colaterales, cuyo derecho se halla pre-
      fijado por la lei de 1793, no derogado por la de 1810.
      
      Tiempo es ya de terminar la pesada tarea que he emprendido.
      Basta lo dicho para hacer conocer á los redactores de la Gazeta de
      Madrid, que el artículo del Sr. Escriche que han copiado, va erra-
      do en su principal objeto; desatina en casi todos los puntos legales
      que incidentalmente toca; es un alegato indigesto en que se vuelve
      á cada paso á especies ya insinuadas, se mezclan inoportunamente
      algunas, hai contradiccion entre ellas, y en una palabra se advier-
      te por todas sus partes, que está mui léjos de ser un modelo de len-
      guaje, estilo y saber, como lo han creido. Su desengano importa
      con todo mucho ménos que el del público, el cual, viendo adop-
      tadas en un Diccionario de legislacion ciertas doctrinas, podia admi-
      tirlas sin exámen, y conviene por lo mismo advertirle que se ha-
      llan en contradiccion con los buenos principios del Derecho.
